Terms of Service

These terms govern all use of Wave Polling and Research estimates and dashboards — public and client. In short: estimates are model output, provided as is, and you use them entirely at your own risk.

1. Acceptance of these terms

These Terms of Service (the “Terms”) are a binding agreement between you and Wave Polling and Research, LLC (“Wave,” “we,” “us”). By accessing wavepolling.com, the public Tracker at wavepolling.com/tracker/, any private or client dashboard, API, data file, report, or other product we provide (together, the “Services”), or by using any estimate, figure, or other output of the Services (the “Estimates”), you accept these Terms. If you do not accept them, do not use the Services or the Estimates.

2. What the Estimates are

The Estimates are outputs of statistical models applied to survey data. Like all survey research and statistical modeling, they carry uncertainty, including sampling error, modeling error, and error from sources that cannot be quantified. Estimates are provided for general informational purposes only. They are not predictions, guarantees, or statements of fact about any individual, election, market, or outcome, and we may revise, correct, or withdraw any Estimate at any time without notice.

3. Use at your own risk; no warranties

The Services and the Estimates are provided “as is” and “as available,” without warranty of any kind, express or implied, including any warranty of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, or non-infringement. Your use of the Services and any reliance on any Estimate is entirely at your own risk. You are solely responsible for any decision — political, commercial, financial, editorial, or otherwise — made in reliance on the Estimates, and for independently verifying any information before acting on it.

4. Release and hold harmless

To the maximum extent permitted by law, any party accessing or using the Services or the Estimates releases, and agrees to hold completely harmless, Wave Polling and Research, LLC and its members, managers, officers, employees, contractors, and agents (together, the “Wave Parties”) from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) of every kind — whether known or unknown, direct or indirect, foreseeable or not — arising out of or in any way connected with the Services, the Estimates, or any use of or reliance on them.

5. Limitation of liability

To the maximum extent permitted by law, the Wave Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Services or the Estimates, under any theory of liability, even if advised of the possibility of such damages. The Wave Parties’ total aggregate liability for all claims arising out of or relating to the Services or the Estimates will not exceed the amounts you paid Wave for access to the Services in the twelve months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, the Wave Parties’ liability is limited to the fullest extent the law allows.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Wave Parties from and against any claim, demand, or proceeding brought by a third party, and all resulting damages, losses, costs, and expenses (including reasonable attorneys’ fees), arising out of your use of the Services or the Estimates, your publication or redistribution of any Estimate, or your breach of these Terms.

7. No professional advice

Nothing in the Services or the Estimates constitutes legal, financial, investment, tax, or other professional advice, and no fiduciary, advisory, or professional relationship is created by your use of them. Wave is not a licensed investment, legal, or financial advisor.

8. Client dashboards and separate agreements

These Terms apply to all Wave dashboards and data products, including private, client, and subscriber dashboards and any API or file delivery. If you access the Services under a separate written agreement with Wave (such as a master services agreement, statement of work, or subscription agreement), that agreement governs where it conflicts with these Terms; these Terms govern everything it does not address. Sections 3 through 6 (no warranties, release and hold harmless, limitation of liability, and indemnification) apply to all users of the Estimates in every case, unless a separate written agreement expressly states otherwise.

9. Permitted use and intellectual property

The Services and the Estimates, including all text, figures, models, and data compilations, are the property of Wave Polling and Research, LLC. You may quote or reproduce individual Estimates from the public Tracker for news reporting, research, and other non-commercial purposes with attribution to “Wave Polling and Research.” Bulk downloading, scraping, systematic collection, resale, or commercial redistribution of the Estimates requires Wave’s prior written permission; a subscription whose plan includes the data API carries that permission for retrieval through the API, within its published limits and for the subscriber’s own internal use, and for nothing further. Client deliverables may be used as the applicable agreement provides. Credentials, API keys, and access links issued to clients are confidential and may not be shared.

10. Availability and changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time without notice or liability. We are under no obligation to maintain, update, or continue publishing any Estimate.

11. Changes to these Terms

We may revise these Terms at any time by posting the revised version at wavepolling.com/terms/ with a new effective date. Your continued use of the Services after a revision takes effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to their jurisdiction.
